Terms of service

These terms of service (the “Terms”) apply to your purchase and use of the Speed of Light WordPress plugin (the “Plugin”), the Speed of Light cloud optimization service (the “Cloud Service”) and the website at speedoflight.pro (the “Site”), all provided by Digitaldive (“we”, “us”, “our”).

1. Agreement

By starting a trial, buying, installing or using the Plugin or the Cloud Service, or by using the Site, you agree to these Terms. If you accept them on behalf of a company or other organization, you confirm that you can bind it. If you don't agree, please don't use the Plugin, the Cloud Service or the Site.

2. Your license

While your subscription or trial is active, we give you a non-exclusive, non-transferable license to use the Plugin and the Cloud Service on the number of WordPress sites your tier allows. Licenses are issued and activated through our reseller, Freemius.

• Site limits. The 1-site tier (Solo) covers 1 site, the 50-site tier (Studio) covers up to 50 sites, and the unlimited tier (Agency) covers an unlimited number of sites. Every tier includes every feature; only the number of sites differs.
• Client work. You may use the Plugin on your own sites and on sites you build or manage for clients, within your site limit.
• Moving a license. You can free up an activation by deactivating the license on a site, then use it on another one.
• No resale. You may not resell, share, sublicense or publish your license key, or offer the Plugin or the Cloud Service as your own product.

The Plugin's WordPress code is licensed under the GNU General Public License (GPL). These Terms cover your subscription, license key, the Cloud Service, updates and support. They do not reduce any rights the GPL gives you.

3. Free trial

Every tier starts with a 7-day free trial that includes every feature, including the Cloud Service and Autopilot. A payment card is required to start it. Unless you cancel before the trial ends, it converts automatically into a paid yearly subscription for the tier you chose, and your payment method is charged. You can cancel the trial at any time from your account or the Freemius customer portal.

4. Billing and renewals

The Plugin is sold as a yearly subscription. Current prices are shown on our pricing page; at the time of writing they are 1 site for $20 a year, 50 sites for $99 a year, unlimited sites for $179 a year, in US dollars and excluding any applicable taxes.

• Payments. Freemius is our authorized reseller and merchant of record. It processes payments (cards and PayPal), handles sales tax or VAT and issues your invoices. By buying, you also agree to Freemius's checkout terms.
• Automatic renewal. Subscriptions renew every year at the then-current price using your saved payment method, until you cancel. Price changes never affect a term you have already paid for.
• Cancelling. You can turn off renewal at any time from your account or the Freemius customer portal, or by emailing us. Your license stays active until the end of the paid term.

5. Refunds

Because the free trial lets you try everything first, we don't offer refunds once a trial has converted to a paid subscription, or for renewals. If you were charged by mistake, for example twice or after you cancelled, email help@speedoflight.pro and we will put it right. Our refund policy has the details. Nothing in these Terms limits rights you have under consumer law that cannot be excluded.

6. The cloud service

Sites with an active license or trial can use the Cloud Service, which loads the public pages of your site in a headless browser at desktop and phone widths and returns optimization plans. By activating the Plugin on a site, you allow us to fetch and analyze that site's public pages for this purpose. Please only use it on sites you own or manage.

To keep the service fair and reliable, daily usage limits may apply; the Plugin shows when a limit is reached and when it resets. We may change, improve or temporarily pause parts of the Cloud Service, for example for maintenance or security. If the Cloud Service is unavailable, the Plugin's page cache and local optimizations keep working.

7. Updates and support

An active subscription or trial includes Plugin updates and email support at help@speedoflight.pro. We usually reply within 24–48 hours. We aim to support current versions of WordPress (6.0 and later) and PHP (7.4 and later), but we can't guarantee compatibility with every theme, plugin, host or third-party service.

8. If your license ends

If your subscription ends or is cancelled, page caching and the local optimizations keep working on your sites. Cloud optimization, Autopilot, cloud scans, updates and support stop until you renew.

9. Acceptable use

You agree not to use the Plugin, the Cloud Service or the Site to break the law or anyone's rights; to get unauthorized access to our systems or licensing; to get around license checks, site limits or usage limits; to overload or interfere with the Cloud Service; or to point the Cloud Service at sites you don't control. You are responsible for keeping backups of your sites and testing significant changes.

10. Ownership

The Cloud Service, the Site and the Speed of Light name, logo, documentation and designs belong to Digitaldive or its licensors. Apart from the license in these Terms and your rights under the GPL, no rights are transferred to you. Your website and its content remain yours.

11. Warranty and liability

The Plugin, the Cloud Service and the Site are provided “as is” and “as available”. As far as the law allows, we make no warranties of any kind, express or implied, including fitness for a particular purpose, merchantability and non-infringement. We don't promise any particular speed, score or ranking, because results depend on your hosting, theme, plugins and content.

As far as the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or goodwill, arising from your use of, or inability to use, the Plugin, the Cloud Service or the Site. Our total liability for any claim is limited to the amount you paid us in the twelve months before the event that led to the claim.

12. Changes and governing law

We may update these Terms from time to time. When we do, we will change the date at the top of this page and, where appropriate, give additional notice. If you keep using the Plugin, the Cloud Service or the Site after a change takes effect, the updated Terms apply.

These Terms are governed by the laws of the country where Digitaldive is established, without regard to conflict-of-law rules. This does not take away any protection you have under the mandatory consumer laws of the country where you live.
